RESOLUTION NO. 2001-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOLANA BEACH, CALIFORNIA DECLARING THE PROVISIONS OF LAW AUTHORIZING FORMATION OF A GEOLOGICAL HAZARD ABATEMENT DISTRICT TO BE APPLICABLE WITHIN THE CITY
WHEREAS, the formation of a geological hazard abatement districts ("GHADs") for the prevention, mitigation, abatement and control of geological hazards and structural hazards resulting from geological hazards are authorized under Division 17 of the Public Resources Code; and

WHEREAS, the lack of stability of the ocean bluffs within the City of Solana Beach poses serious hazards to the safety of the beach-going public, as well as to local residents and structures located on or near the beach and bluffs; and

WHEREAS, development and implementation of a comprehensive, environmentally-sound plan for the abatement of these hazards would be in the best interests of the City, the public and property owners along the Pacific Ocean; and

WHEREAS, establishment of a GHAD requires development of a plan of control which describes in detail the geologic hazard, its location and the area affected thereby, and a plan for the prevention, mitigation, abatement and control thereof; and

WHEREAS, any GHAD to be formed or implemented would require the support and approval of a majority of the property owners whose properties would be included within such a district, and assessed according to their special benefits, following public hearings; and

WHEREAS, formation of a GHAD would provide a publicly-accountable agency which could use both private and public funds to address a critical health and safety problem within the city; and

WHEREAS, the Beach and Bluff Conservancy, representing many such property owners, has asked the City of Solana Beach to take the steps necessary to allow its citizens to seek to form a GHAD to comprehensively and consistently address the geological hazards that exist on the beaches and bluffs within the city, rather attempting to mitigate such hazards on a property-by-property basis; and

WHEREAS, approval of a resolution by the City Council is necessary to render the provisions of the Geological Hazard Abatement District law operative within the City of Solana Beach;

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Solana Beach:

  1. The City Council of the City of Solana Beach hereby declares that it is subject to the provisions of Division 17 of the Public Resources Code.
  2. The City Clerk is hereby directed to forward a certified copy of this resolution to the State Controller of the State of California, forthwith.
  3. The Planning Director is hereby directed to return within 45 days with a report regarding the advisability of establishment of a GHAD within the city, including its costs, advantages and any disadvantages, whether formation should be initiated by the City Council, whether city property should be included, the elements which should be included in any plan of control, the manner in which the District should be governed, and any support which the city should provide for the ongoing administration of a District.
